All bookings are subject to the following Terms and Conditions as agreed to at the time of booking and a PDF should be downloaded for your own records.
‘The Georgian Apartment’ is referred to as ‘the Property’
The customer renting the Property is referred to as ‘the Guest’
Ian and Helen Paterson are referred to as ‘the Owners’
A booking represents a contract between the Guest and the Owners and is defined by the Owners receiving payment (deposit or in full) and in turn accepting the booking by issuing written confirmation of the booking for the rental period. The contract binds the Guest and all members of his/her/their party, all members of the party are jointly and severally liable under it.
Failure to comply with these terms and conditions or to disclose all relevant information may lead to termination of the contract and loss of the booking.
Bookings will only be accepted from persons over the age of 21 years at the time of the start of the rental period.
The Owners reserve the right to refuse a booking without having to provide a reason.
This contract does not create a tenancy. The Guest and his/her/their party are granted a license to occupy the Property between the agreed dates set out in the booking.
Duration of Rental
Rentals will commence from 3.00pm on the first day of the rental period and conclude at 11.00am on the final day of the rental period unless otherwise arranged in writing. The rental period can only be extended if approved by the Owners and the Guest will be liable to pay the price of any extension before it commences.
The Guest will either be met in person by the Owners or the keys left in a secure key safe by the front door, the combination of which will be provided prior to the period of rental commencing.
Checking in or out between the hours of 9.00pm and 7.00am is not permitted without the prior agreement in writing of the Owners and is at the discretion of the Owners. Checking in or out between the hours of 9.00pm and 7.00am would require the presence of the Owners and an additional out of hours checking fee of £75.00 to be paid prior to arrival by arrangement.
The Guest will ensure on departure that all windows and the front door are locked with the door keys being placed in the key safe by the front door and the safe locked properly. If door keys are not returned safely then the Guest will be liable for any locksmith charges associated with changing locks and replacing keys.
Unless otherwise agreed in writing the price of the rental period shall be as stated on the website of the Property (www.georgianapartment.co.uk) at the time of booking. The price includes all electricity and gas, hot water, central heating, fresh bed linen and towels. There is no request by the Owners for an additional security deposit.
A non-refundable deposit of 25% of the total cost of the rental period is payable at the time of booking, an email receipt of this payment and confirmation of the booking will be supplied. The remaining balance must be paid no later than 6 weeks prior to the commencement of the rental period. Should this balance not be received by the due date then this will be taken as a cancellation and the Guest will remain liable to pay the balance of the rental period.
If the booking is made within 6 weeks of the commencement of the rental period then full payment would be due.
Payment methods accepted include card (debit or credit) and BACS/bank transfer. Unfortunately the Owners can no longer accept payment by cheque.
The Owners bear no responsibility for sending reminders of the due date for full payment to be made.
In making a booking the Guest accepts full responsibility for any theft, breakage or damage cause by him/her/them and any member of his/her/their party and agree to indemnify the Owners in full for any losses incurred.
Cancellations by Guest
All cancellations must be notified to the Owners immediately by both telephone and in writing.
Cancellation more than 6 weeks before the start of the rental period will result in forfeiture of the deposit by the Guest and reimbursement of the balance, if already paid, by the Owner.
Cancellation less than 6 weeks before the start of the rental period will result in forfeiture by the Guest of the full balance.
The Owners strongly recommend that the Guest takes out comprehensive travel insurance, which is inexpensive and readily available, to help cover the costs of cancellation.
Cancellation by Owner
The Owners will not cancel the booking except in exceptional circumstances beyond their control. Notification of any cancellation will be given as soon as is possible and all payments made for the rental period promptly refunded, or alternative holiday dates offered where available.
Any liability for cancellation will be limited to payments previously made by the Guest to the Owner specific to the rental period being cancelled.
The Owner will not reimburse Guests who have to cancel at short notice on account of testing COVID positive or having to self-isolate. Owners are advised to take out holiday insurance policies to cover these situations.
If the Guest or any of his/her/their party developed COVID or was required to self-isolate during the rental period we advise that you return home as soon as is possible and inform the Owner of the situation immediately. If the Guest or any of his/her/their party choose to remain in the Property they would be liable for any additional charges this would incur including those related to the disruption caused to bookings of incoming guests.
Should Edinburgh return to a lockdown situation on account of COVID the Guest will be entitled to alternate dates subject to availability and seasonal pricing differences OR a full refund including deposit. Any new booking would be subject to seasonal price differences, terms and conditions at the time of re-booking and need to be taken within 12 months of the original rental period unless agreed otherwise in writing with the Owner.
Smoking and the Use of Candles
Smoking and the use of candles are both prohibited in all parts of the Property to minimise the risk of fire, naked flames are not permitted within the Property. Infringement of this will result in immediate termination of the occupancy and forfeiture of all payments made by the Guest.
Pets are not permitted within the Property and infringement of this will result in immediate termination of the occupancy and forfeiture of all payments made by the Guest.
Visitors are prohibited in all parts of the Property unless by previous written agreement with the Owner. Infringement of this could result in immediate termination of the occupancy and forfeiture of all payments made by the Guest.
The number of persons using the accommodation must not exceed two and the Owners reserve the right to terminate the occupancy without refund if this is breached.
Regretfully children under the age of 10 at the start of the rental period are not permitted. Children aged 10-18 years must be always supervised by a responsible adult.
The Guest undertakes to pay for any losses or damages to the Property and its contents (with the exception of crockery and glassware which are exempt) caused by the Guest or any of his/her/their party. The Guest should inform the Owner immediately of any losses or damage in order that items can be replaced or repaired prior to future arrivals. We do not request a security deposit but in turn request that you are honest about any damage or breakages.
The Guest undertakes to take good care of the Property and leave it in a clean and tidy condition at the end of the rental period, with the exception of bed linen and towels to be laundered.
The Owners reserve the right to charge the Guest to cover any additional cleaning costs if the Property is left in an unacceptable condition.
The Guest may not sell or transfer the booking to another party without the agreement in writing of the Owner.
The Guest undertakes not to cause annoyance to occupants of the adjoining properties. Unreasonable behaviour by the Guest or any of his/her/their party with respect to others in adjoining properties will result in termination of the occupancy by the Owner and forfeiture of all payments made by the Guest. The property is equipped with noise monitoring devices in the kitchen/dining room and drawing room only, these do not record audio or sounds but only overall noise levels in the form of decibel scales.
A comprehensive manual and information sheets about the Property’s facilities can be located on the kitchen worktop on arrival.
Free unlimited WiFi is provided, included in the rental charge, subject to technical availability.
White goods, electrical and gas appliances cannot be guaranteed. In the event of any breakdown during the rental period the Owners will make every effort to repair or replace an item that has malfunctioned as soon as is possible.
The Owners accept no liability for any temporary defect or malfunction of any equipment or appliance in the Property.
Bed linen and towels are provided and will be replenished after one week should the rental period be longer than this. A cleaning service is not provided during the rental period.
If the Guest or any member of his/her/their party have mobility restrictions or other disabilities please contact the Owner prior to booking to check whether the Property will be suitable.
All moveable items must remain on the premises and not be moved from the Property.
The Owners retain the right of access to the Property.
Any problems or complaints during the rental period should be made immediately to the Owner. If the Owner is denied the opportunity to make matters right by the Guest during the rental period then the Guest will waive all rights of redress.
Any complaints not reported to the Owner during the rental period will not be considered.
Unfortunately there is no EV (electric vehicle) charging facility at the Property and use of domestic electricity via a charging cable run from the house is strictly forbidden on health and safety grounds. Infringement of this rule will result in immediate termination of the occupancy by the Owner and forfeiture of all payments made by the Guest.
Any personal items left at the Property will be disposed of within 60 days of the rental period ending if not claimed. All foods and beverages left behind will automatically be disposed of at the time of changeover.
The Owners accept no liability for loss of, or damage to the possessions of the Guest and those of his/her/their party.
